INTRODUCTION.


The Perogative Court of Canterbury is where on would find copies of wills of folk who held possessions in more than one county. These are now available via Ancestry.co.uk. Since 1858 copies of all wills used to be held at Somerset House in London but these have now been moved elsewhere. Administrations (Admins) are issued when a deceased person with possessions has not made a will.

This page was created to house the will of Thomas Walford Marshall, the owner of Harvington Mill, who died in 1827 and William Hawkes Marshall who died in 1853. There are however many wills out there of Harvington folk which would have a natural home on this page hence its creation.

This is the last Will and testament of me
Thomas Walford Marshall of Harvington in the County of Worcester
Gentleman ffirst I will and direct that all my just debts and ffuneral and
testamentary Expenses be paid and defrayed out of my personal Estate
which I conceive will be abundantly Sufficient for that purpose I give and
devise all my ffreehold Water Corn Mills with the Lands and Hereditaments
thereto belonging Situate lying and being in the Parish of Harvington
aforesaid in the said County of Worcester with their and every of their
Appurtenances and which I sometime since purchased of the trustees of
Mr Edmund Smith unto and to the use of William Marshall Hawkes
otherwise William Hawkes Marshall Son of Mary Hawkes of Harvington
aforesaid Spinster his heirs and Assigns for ever charged and Chargeable
nevertheless with the Sum of Two hundred Pounds a piece to each of my
Nephews and Nieces hereinafter named that is to say Thomas Bennett
John Bennett William Bennett Elizabeth Heekes Widow Alice Bennett
Mary Tasker and Sarah Bennett Sons and Daughters of my late Sister
Sarah Bennett William Warren Son of my late Sister Elizabeth Warren
and Elizabeth Gould daughter of my Sister Alice Gould Widow And I give
and bequeath the said Sum of two hundred Pounds to each of my said
Nephews and Nieces accordingly and I direct that the same shall be paid
to them within twelve Calendar Months next after my decease And I give
and devise all the rest and residue of my ffreehold Messuages Lands and
Hereditaments Situate lying and being in the Parish of Harvington
aforesaid and elsewhere in the said County of Worcester with their and
every of their Appurtenances and all other my real Estate whatsoever and
wheresoever unto and to the use of the said William Marshall Hawkes
otherwise William Hawkes Marshall his heirs and Assigns for ever I give
devise and bequeath all and singular my Copyhold Messuages Lands
tenements and Hereditaments Situate lying and being in the Parish of
Harvington aforesaid and held by me for lives under the Dean and Chapter
of Gloucester by Several grants or Copies of Court Roll of the Manor of
Harvington heretofore made to me or others in trust for me with their
and every of their Appurtenances unto the said William Marshall Hawkes
otherwise William Hawkes Marshall his Executors Administrators and
Assigns for and during the several lives named in the said several
grants or Copies of Court Roll and for and during all such other Estate term
and Interest as I shall have therein at the time of my decease I give
devise and bequeath all my Leasehold Messuages Lands and Heredits
Situate Lying and being in the said Parish of Harvington with their
Appurtenances and held by me by lease for years under the said Dean
and Chapter of Worcester unto the said William Marshall Hawkes otherwise
William Hawkes Marshall his Executors Administrators and Assigns for
and during the rest and residue of the term for which the same Hereditaments
were demised and granted and for and during all such Estate term and
interest as I shall have therein at the time of my decease I give devise
and bequeath one Annuity or yearly Sum of fifty Pounds unto the said

Mary Hawkes and to be paid to her and her Assigns for and during the term
of her natural life without any reduction or abatement whatsoever by
two equal half yearly Payments in every year the first payment whereof
to begin and be made at the end of Six Calendar months next after my
decease and I do hereby charge and make Chargeable all my said ffreehold
Messuages Lands and Hereditaments with the Payment thereof accordingly
And I give and bequeath unto the said Mary Hawkes and her Assigns the
usual powers and remedies by distress entry and action for the recovery
of the said Annuity or yearly Sum of fifty Pounds as and when the same
or any part thereof shall happen to be in arrear I give and bequeath all
the rest and residue of my Chattel real Estate and all my Personal Estate
whatsoever and wheresoever and of what nature kind or quality so ever the
same may be and consist or which I shall be in any ways possessed of or
entitled unto at the time of my decease unto the said William Marshall
Hawkes otherwise William Hawkes Marshall his Executors Administrators
and Assigns to and for his and their own use absolutely And I nominate and
appoint my Brother Nicholas Marshall the said William Marshall Hawkes
otherwise William Hawkes Marshall and my ffriend William ffrederick
Preedy of Offenham in the County of Worcester Gentleman Executors of this
my last Will and testament hereby revoking all former Wills and revocable
deeds by me at any time heretofore made and executed and so declare
this to be my last Will and testament In testimony whereof I have to this
my last Will contained in these sheets of Paper set my hand and seal to this third and
last Sheet the eighth day of April in the year of our Lord One thousand eight

last Will and testament in the presence of us who in his sight at his request
and in the presence of each other have hereunto subscribed our names as

[Codicil:]
This is a Codicil to my last Will and testament and which I hereby direct
shall be taken as part thereof whereas I have in and by my Will
given and bequeathed unto Elizabeth Gould daughter of my late
Sister Alice Gould Widow the Sum of two hundred Pounds now I do
hereby revoke and make void such bequest to the said Elizabeth Gould
who has since the date of my said Will intermarried with Thomas
Pearce and do hereby direct that she shall have no benefit or advantage
under my Will in all other respects I ratify and confirm my said
Will Witness my hand this fourteenth day of September One thousand

Proved at London with a Codicil 27th March 1827 before the Judge by
oaths of Nicholas Marshall the Brother William Hawkes Marshall and
William ffrederick Preedy the Executors to whom Admon was granted having
been first sworn by Commission duly to Administer.

This is the last Will and testament of me William Hawkes Marshall of Harvington in the County of Worcester Gentleman
I give and devise to George Malin of the Union Mill Birmingham Miller All my real estate what
soever and wheresoever save the Cottage and Garden hereinafter devised to Winifred Cresswell
to hold to him his heirs and assigns for ever And I give and bequeath unto the said George
Malin and unto Henry Sisam of Avon Mill near Alveston in the County of Warwick Miller
All my personal estate and effects whatsoever and wheresoever To hold to
them their executors administrators and assigns Upon Trust to pay thereout all my just debts
funeral and testamentary expenses and the expenses of proving this my last Will as also the
following Legacies which I direct shall be paid to the respective Legacies within three calen-
dar months after my decease next To Mrs Caroline Keyte the mother in law of the said
George Malin the sum of one thousand pounds to Mrs Winifred Cresswell the wife of William
Cresswell my ffarm Bailiff the like sum of one thousand pounds to Thomas Cresswell her son
and to Elizabeth Beasley her daughter the sum of two hundred pounds a piece to Mary Hawkes
of Harvington widow the sum of five hundred pounds to William Cresswell of Evesham ffelt
monger one hundred pounds and to the said Henry Sisam the sum of nineteen quineas and
subject thereto Upon Trust to pay over the residue of such my personal estate unto the said
George Malin his executors administrators and assigns absolutely And I do hereby direct
that in the event of my personal estate proving insufficient to discharge the various payments
I have subjected it to then I charge my real estate so devised to the said George Malin with
the payment thereof And I give and devise unto the said Winifred Cresswell all that Cottage
tenement garden and premises situate at Church Lench in the County of Worcester now in
the occupation of Charles Cresswell To hold to her her heirs and assigns for ever And I ap-
point the said George Malin and Henry Sisam joint Executors of this my will In testa-
mony whereof I have hereunto set my hand and seal this third day of October one thou-
sand eight hundred and fifty two - Wm Marshall - Signed sealed and deliver
ed by the above named William Hawkes Marshall as and his last Will and Testament
in the presence of us who in his presence at his request and in the presence of each other have
